Change One Thing At Mediation…. Take Your Pick!

Great leaders are great negotiators and effective negotiation is essential at mediation. When attending mediation, everyone has their own style, intention and methods about how they show up and how to resolve conflict/disputes. Its the same for Mediators. With the wide variety in styles, intentions, conventions, how do you know what are the best negotiation and mediation practices? Harvard Law School, Program on Negotiation, is a widely recognized preeminent leader in the field of negotiation, negotiation research, and dispute resolution, which provides tried and tested best practices for negotiation and mediation. Essential Conflict Resolution, Leadership & Life Skill: INFLUENCE

When was the last time you spoke to your 6 year old asking them to brush their teeth before bed, go back to bed, hurry up and get ready for school, without success? Think about a time you spoke with your spouse/partner/friend/family and you wanted them to agree with you on a topic, without success? Think about the last time you attended a mediation, when you spoke (or observed others speak) at the opening, when the other side was informed of the strength of your case, their case was diminished [and they need a better handle on the law]. You may have been surprised they didn't 'come to their senses'. :-) Getting others to agree with you , having satisfying relationships, asking others to comply when we ask for help or when trying to alter others behaviour or thinking, sell our services or ideas or be an effective leader.... ALL require high levels of influence. Many people think influence involves force . It is, however, a skill, it takes time, effort and intention to … [Read more...]

An effective leader will use strategic influence designed to change another person or teams attitudes, beliefs or actions, to inspire them to do better. A mother or father will want effective influencing skills when interacting with their 4 year old. Their strategic influence will be different when trying to influence their teenager. Conflict resolution, whether at mediation or advocating in court, requires high influencing skills, its based on people skills and strategy. Every day, we are influencing family, friends, colleagues, clients, counterparts anyone who crosses our path. Louise provides some thought provoking ideas and questions to help you to think differently about influence! Watch the the video for full training. 1. Be The Leader YOU Want To Follow!

Are you new to the profession and at the perceived bottom of the hierarchy ladder, feeling voiceless, powerless? Do you trust your leaders? Do you feel safe at work every day? Do you feel protected and allowed to be yourself? Is it possible for you to be a leader? Do you hold a position of seniority, you have made your way up the hierarchical ladder in the profession, and believe you are automatically a 'leader"? Whats the difference between leadership, position/authority? Louise is inspired by Simon Sinek (Leadership Expert) and Brendon Burchard (High Performance Institute) on what makes a leader? Who can be a leader? Are you a leader or a person with position and authority? #holisticbarrister, mediator #FDRP #arbitrator #highperformancecoach (CHPC) #highperformanceconsultant (CHPC) #eqcoach #eqconsultant #leadership #Harvard #makeadifference. … [Read more...]

Lawyers Are Taught To Dehumanise! Lets Be Exemplary Human Role Models

Summary: Summary: Lawyers are taught to dehumanise from law school, where emotions and human skills are devalued and dismissed, thought of as unnecessary in practice and technicality seen as the only skill required for greatness (of course technicality is necessary). A high standard of humanity is required to be great people, leaders, role models in the world and in law. Our staff, clients, colleagues, counterparts, families, friends are depending on us to show up as our best selves in practice to serve them with excellence. . Lawyer's aren't literally killing people at work through dehumanisation, however, lawyers may be dehumanising others and not even know they are doing it! This vlog provides 3 vital skills to ensure you get on the ramp or road to role model greatness as they will begin the path for greater humanity in law. We are all humans with responsibilities and accountability to other humans and therefore can't act like the 3 Police officers who stood … [Read more...]
